Please read these terms carefully before using RentPay Kenya

1. Introduction

Welcome to RentPay Kenya ("Platform", "we", "us", or "our"). These Terms and Conditions govern your use of the RentPay Kenya platform, accessible at rentpaykenya-production.up.railway.app and any associated applications or services.

By registering for an account or using our Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

3. Account Registration

To use the Platform, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years of age to register. By registering, you represent that you have the legal capacity to enter into this agreement.

4. User Roles and Responsibilities

4.1 Landlords

Landlords may list properties, manage units, assign tenants, send notices, track payments, and generate lease agreements. Landlords are responsible for the accuracy of property information, compliance with Kenyan landlord-tenant laws, and timely resolution of maintenance requests.

4.2 Tenants

Tenants may pay rent, submit maintenance requests, book service providers, and communicate with landlords through the Platform. Tenants are responsible for timely rent payment and proper use of the premises as outlined in their lease agreement.

4.3 Service Providers

Service Providers may create profiles, set service areas, accept or negotiate bookings, and receive ratings. Providers are responsible for delivering quality services as agreed and maintaining professional conduct.

5. Payments and Fees

5.1 Rent Payments

Rent payments are processed via M-Pesa through the Platform. RentPay Kenya facilitates the transaction but is not a party to the landlord-tenant rental agreement. Payment confirmations and receipts are generated automatically.

5.2 Platform Fees

Landlords are charged KES 500 per property per month. Service Providers are charged KES 100 per month. Failure to pay platform fees may result in restricted access to certain features.

5.3 Late Rent Penalties

A late payment fee of 5% of the monthly rent may be applied to rent payments received more than 5 days after the due date, as specified in the lease agreement generated through the Platform.

6. Security Deposits

Security deposits are held in escrow through the Platform. Move-in and move-out inspections must be documented. Deposits are refundable within 30 days of move-out, less any deductions for damages or unpaid rent. An itemized deduction list will be provided to the tenant.

7. Lease Agreements

The Platform generates lease agreement PDFs for convenience. These documents serve as a record of the agreement between landlord and tenant. Both parties should review, sign, and retain copies. RentPay Kenya is not a party to the lease and does not provide legal advice.

8. Service Bookings

The Platform connects users with Service Providers. RentPay Kenya does not guarantee the quality, timeliness, or outcome of services provided. Users engage Service Providers at their own risk. The rating system is provided to help users make informed decisions.

9. Privacy and Data Protection

We collect personal information necessary to provide our services, including names, phone numbers, email addresses, and payment information. We do not sell personal data to third parties. Data is stored securely and used only for Platform operations.

By using the Platform, you consent to the collection and processing of your data as described herein and in compliance with applicable Kenyan data protection laws.

RentPay Kenya provides the Platform on an "as is" basis. We make no warranties regarding the uninterrupted availability of the Platform. To the maximum extent permitted by law, RentPay Kenya shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

RentPay Kenya is not liable for disputes between landlords and tenants, the quality of services provided by Service Providers, or the condition of listed properties.

12. Termination

We may suspend or terminate your account if you violate these Terms or engage in prohibited activities. You may close your account at any time by contacting support. Termination does not relieve you of any outstanding payment obligations.

13. Dispute Resolution

Any disputes arising from these Terms shall first be resolved through good faith negotiation. If negotiation fails, disputes shall be referred to mediation. If mediation is unsuccessful, disputes shall be resolved through arbitration or a court of competent jurisdiction in Nairobi, Kenya.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Users will be notified of material changes via the Platform or email. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
